Cosmic Crown Showdown Terms and Conditions

The following conditions govern the course of the Cosmic Crown Showdown (“competition”) as organized by Hex Entertainment, LLC. 25351 Commercentre Dr. Suite 250, Lake Forest, CA. USA (“HXE”).

  1. Subject and Period of Competition
    • The subject of this competition is a two-month season (“season”) followed by subsequent final tournaments. During the season, scored matches are played out in two ladders, each using a different format, whereby participants are determined for the final tournaments as detailed in Sections 4 and 5 of these terms and conditions.
    • The season and subsequent tournaments take place between 11/1/2017 and 1/14/2018 (“competition period”).
  1. Participation Requirements
    • All players of full age with a personal and active account for www.hextcg.com (“account”) are eligible to enter (“user”). Employees of Hex Entertainment, LLC and the companies associated with them, or spouses and relatives thereof, are ineligible to participate.
    • A “participant” is every eligible user who participates in a ladder match with their account in accordance with the following conditions.
    • Participation is free in principle and is not bound to the purchase of any goods or the subscription to a fee-based service.
  1. Ladders and Ladder Winners
    • During the season, participants can take part in scoring matches for both ladders between 11/1/2017 and 12/31/2017.
    • Those participants who occupy one of the top 64 places in at least one of the two ladders at the end of the season will be deemed “ladder winners”. The achievement of a cosmic rank during the competition period is required for such a placement.
    • The ladder winners receive a non-transferable “tournament ticket” for their ranking in the respective ladder, and thus the eligibility to participate in the “qualification tournament” as detailed in Section 4 below.
  1. Qualification Tournament and Qualification Winners
    • The qualification tournament will start at 9 AM PT on 1/13/2018. “Qualification participants” are those ladder winners who use the tournament ticket they receive and participate in the qualification tournament. The use of multiple accounts is not permitted. Depending on the number of qualification participants, the qualification tournament may be played out over the course of up to seven rounds. The rank is determined by the final score. The eight highest placed qualification participants following this tournament are the “qualification winners”.
    • HXE will notify the qualification winners via in-game message or via an email to the email address linked to the respective account by 1/13/2018 (“qualification notification”).
    • The qualification participants who are not qualification winners will receive special in-game prizes; as part of the qualification notification, qualification winners will receive an invitation to take part in the “showdown” in accordance with Section 5 below. A cash disbursement and/or payment of the in-game prizes in goods, or the exchange and/or transfer to third parties or other accounts is excluded in each case.
  1. Showdown and Showdown Winner
    • The showdown will start at 9 AM PT on 1/14/2018 and consist of a single elimination format with up to three rounds. The qualification winners who take part in the showdown, as well as any lucky losers participating in accordance with Section 5 (2) below, are the “finalists”. The use of multiple accounts is not permitted.
    • If qualification winners do not participate in the showdown, they forfeit any right to the payment of a cash prize as detailed in Section 6 (1), merely being rewarded with the in-game prizes as detailed in Section 4 (3). In this case, the ninth and where necessary tenth-placed qualification participants receive the chance to take part in the showdown (“lucky losers”). HXE will invite potential lucky losers to participate immediately after the planned start of the showdown via in-game message. If this invitation is not followed by participation in the showdown within 2 minutes of receipt, the invitation passes immediately to the tenth-placed qualification participant. Should this invitation not be followed by participation in the showdown within 2 minutes, the showdown will proceed with the correspondingly reduced number of finalists. If a finalist resigns during the last game of the showdown, they will be awarded second place. The “showdown winner” is the finalist who wins the last game in the showdown.
    • HXE will announce the showdown winner and the final rankings of the finalists on hextcg.com by announcing their respective nicknames by 1/15/2018 (“showdown announcement”).
  1. Prize Money
    • The finalists receive the following prize money as per their ranking in the showdown:
      • Qualification winners (i.e. finalists) achieving places 8 through 5 receive prize money to the value of $250 USD;
      • Finalists claiming fourth and third place receive prize money to the value of $500 USD;
      • The finalist who claims second place receives prize money to the value of $1000 USD;
      • The showdown winner receives prize money to the value of $2000 USD, in addition to a special, non-transferable in-game trophy.
    • HXE will transfer the prize money to the respective authorized recipients (“authorized recipients”) as determined by the preceding paragraph exclusively by bank transfer or, where available, via PayPal.
    • The payment of the prize money via bank transfer is subject to the provision of valid bank details, comprising the authorized recipient’s (i.e. account holder’s) name, the name of the bank in combination with the account number and SWIFT/BIC codes, and the IBAN number (or simply the account number, should the account belong to a bank outside of the European Union). Prize money payments made via PayPal require the provision of the respective finalist’s valid PayPal account email address.
    • Payment shall be made within 30 days of provision of the “payment details” as detailed in paragraph 3. Finalists forfeit their right to a prize if these details are not provided in part or in whole to HXE via email to player@hextcg.com by 2/15/2018. Details must be sent via the email address associated with the account used for participation. As far as a payment fails as a result of incorrectly provided payment details, HXE is only obliged to attempt to revoke the erroneous payment made. In as far as this is possible, the respective payment will once more be repeated within 14 days of receipt of the correct payment details, should these be communicated immediately. Otherwise the respective claim to the prize money is forfeit. If the account is being used via Steam, then an additional support ticket must be created from the respective Steam user account. The ticket must include the email address via which the payment details will be sent.
    • Recourse to the courts regarding the determination of ladder and qualification winners, as well as the showdown winner and final placement of the finalists, is excluded in each case.
    • Any taxes and/or other duties due on the respective payment, as well as all resulting fees, shall be borne by the respective authorized recipient, who indemnifies HXE against all liabilities with respect to the responsible financial authorities. The disbursement and/or payment of the prize in goods, or the exchange and/or transfer of the prize to third parties is excluded.
  1. Data Privacy
    • HXE will collect, process and use participants’ personal data solely for the purposes detailed in these conditions and the Privacy Policy in accordance with data protection laws.
  1. Declaration of Consent
    • The participants agree to the qualification notification and showdown announcement.
    • As part of the qualification notification, the finalists further agree to an interview being sent to the email address linked to the account used to participate. A reply to said interview is voluntary.
    • The respective consent may be revoked at any time with future effect by sending an email to player@hextcg.com. No further costs other than the transmission costs stated in the base rates will be incurred.
  1. Disclaimer
    • HXE, its bodies, employees, and subcontractors are liable exclusively for willful intent and gross negligence, regardless of legal basis, and in cases of ordinary negligence, only for the violation of essential contractual obligations and limited to foreseeable damages, as far as not precluded by other compulsory statutory provisions. These limitations do not apply for the loss of life, personal injury or damage to health.
  1. Other
    • The participant agrees to these Terms and Conditions by actively participating in ladder games. In addition to these Terms and Conditions, the Standard Terms and Conditions of Use also apply (together the “rules”). Should a participant infringe upon the rules during the competition period, their eligibility may be revoked.
    • In the event that any individual provisions of these Terms and Conditions become ineffective, the remaining provisions shall remain effective and binding. Statutory rules shall take the place of the ineffective provision.

(2)HXE reserves the right to end the competition at any time, if for technical or legal reasons its proper execution cannot be guaranteed.
